{"id":8868,"date":"2011-06-07T09:00:19","date_gmt":"2011-06-07T12:00:19","guid":{"rendered":"http:\/\/www.funverde.org.br\/blog\/?p=8868"},"modified":"2011-06-07T09:00:19","modified_gmt":"2011-06-07T12:00:19","slug":"promotores-terao-manual-para-driblar-novo-codigo-florestal","status":"publish","type":"post","link":"https:\/\/www.funverde.org.br\/blog\/promotores-terao-manual-para-driblar-novo-codigo-florestal\/","title":{"rendered":"Promotores ter\u00e3o manual para driblar novo C\u00f3digo Florestal"},"content":{"rendered":"<p><span style=\"color: #008000;\">O Minist\u00e9rio P\u00fablico do Estado de S\u00e3o Paulo, antecipando-se \u00e0 aprova\u00e7\u00e3o pelo Senado do novo C\u00f3digo Florestal nos termos atuais, decidiu montar um manual para atua\u00e7\u00e3o dos promotores na defesa do ambiente. <\/span><\/p>\n<p><span style=\"color: #008000;\">At\u00e9 8 de agosto, os promotores do Estado receber\u00e3o orienta\u00e7\u00f5es sobre a\u00e7\u00f5es que poder\u00e3o ser ajuizadas diante da nova legisla\u00e7\u00e3o, al\u00e9m da atua\u00e7\u00e3o em inqu\u00e9ritos, ajustamentos de conduta e inconstitucionalidades.<\/span><\/p>\n<p><span style=\"color: #008000;\">Um grupo de estudos formado por promotores do Gaema (Grupo de Atua\u00e7\u00e3o Especial de Defesa do Meio Ambiente) foi criado para, em 60 dias, apresentar as normativas que integrar\u00e3o o manual. No Estado h\u00e1 sete Gaemas.<\/span><\/p>\n<p><span style=\"color: #008000;\">&#8220;Nosso objetivo \u00e9 garantir uma atua\u00e7\u00e3o integrada e no mesmo sentido das Promotorias, que \u00e9 proteger a sociedade e o meio ambiente&#8221;, disse a promotora e secret\u00e1ria-executiva do Gaema, Cristina Godoy de Ara\u00fajo Freitas.<\/span><\/p>\n<p><span style=\"color: #008000;\">Uma das possibilidades j\u00e1 estudadas no grupo s\u00e3o a\u00e7\u00f5es questionando a inconstitucionalidade por retrocesso legislativo. Seriam questionamentos considerando a Constitui\u00e7\u00e3o Federal e a preserva\u00e7\u00e3o do ambiente.<\/span><\/p>\n<p><span style=\"color: #008000;\">Em um dos casos, a a\u00e7\u00e3o poderia questionar a redu\u00e7\u00e3o de 30 metros para 15 metros da conserva\u00e7\u00e3o de APP (\u00c1rea de Preserva\u00e7\u00e3o Permanente). &#8220;At\u00e9 8 de agosto teremos os resultados para todos os promotores&#8221;, disse Cristina.<\/span><\/p>\n<p><span style=\"color: #008000;\">O promotor de Meio Ambiente de Barueri, Marcos Mendes Lyra, afirmou que vai adotar a estrat\u00e9gia devido ao avan\u00e7o das constru\u00e7\u00f5es sobre as APPs. &#8220;Vamos tentar manter em 30 metros.&#8221;<\/span><\/p>\n<p><span style=\"color: #008000;\">Fonte &#8211; Correio do Povo de Alagoas de 07 de junho de 2011<\/span><\/p>\n<p><span style=\"color: #ff0000;\">Temos que contra atacar, j\u00e1 que os ruralistas est\u00e3o trentando destruir a vida no planeta.
